A Basque haulage firm has been ordered to pay a driver over €20,000 compensation for sending him out in a tipper lorry with no valid ITV (the Spanish equivalent of an MOT). Sinotruk Axle Original Spare Parts

The website of the ELA Union cited a statement from the Superior Court of Justice of the Basque Country, which said that although no accident had occurred involving the lorry, the fact a driver had been allocated a truck that could have been unsafe for the road is a violation of risk prevention laws.

The trucker only drove the tipper lorry for 53 kilometres, but as it had no valid MOT, the court ruled it had been long enough for the driver to be at risk from undetected faults.

The court also ruled that the actions of Excavaciones Imanol Lasa de Irun had violated the rights of the truck driver. As a result, the company was ordered to pay €20,491 to the driver.

It was not the first time the haulier had been found guilty of a road transport violation. The company had previously been punished for overloaded its vehicles.
